Belize International Trusts: Benefits, Requirements and Key Considerations

Managing wealth across borders involves more than choosing where to hold assets. Families and business owners must also consider succession, the needs of beneficiaries, potential disputes and the rules that apply in each relevant country.

A Belize international trust may support these objectives through a flexible legal structure for holding and administering assets. Its suitability depends on the family’s circumstances, the assets involved and the legal and tax implications beyond Belize.

What Is a Belize International Trust?

A trust is a legal arrangement under which a settlor places assets under the ownership and administration of a trustee, who manages them for designated beneficiaries or a permitted purpose, in accordance with the trust deed.

The deed establishes how the trust operates, including the trustee’s powers and the conditions for distributions. A protector may also be appointed with specified oversight or consent powers.

Belize’s Trusts Act provides the framework for these arrangements. International trusts must meet the applicable eligibility and registration requirements; registration is essential to their validity and enforceability under the Act.

Potential Benefits of a Belize International Trust

Family Succession and Continuity

A trust can establish a framework for managing family wealth and making distributions over time. This may be useful where beneficiaries live in different countries, children require long-term support, or a family wishes to preserve business interests across generations.

For example, a trust deed may allow the trustee to apply funds towards beneficiaries’ education, healthcare or maintenance while retaining other assets for future needs.

Effective planning requires coordination with existing wills, ownership arrangements and the laws affecting the assets.

Asset Protection Planning

Belize law contains specific protections concerning certain foreign-law claims, including those relating to inheritance, marriage and creditor claims in insolvency. These provisions are an important feature of its trust framework.

However, asset protection requires a broader assessment. The location of assets, the jurisdictions connected to the parties, existing obligations and the way the trust operates can all affect the outcome.

A Belize trust should therefore form part of considered advance planning. It should not be marketed as a guarantee against litigation or a way to disregard legal obligations.

Confidentiality With Compliance

The international trust register is not generally open to public inspection. This provides a degree of privacy for families who prefer to keep their wealth arrangements outside the public domain.

Privacy remains subject to legal disclosure requirements. Trustees and trust agents must maintain relevant records and identification information, and information may be accessible to competent authorities in accordance with the law. Belize’s 2023 amendments strengthened these obligations.

Flexible Administration

A trust can be structured around the family’s intended approach to distributions and oversight. Depending on the arrangement, beneficiaries may have defined entitlements or the trustee may exercise discretion within the terms of the deed.

This flexibility makes careful drafting particularly important. The deed should clearly address trustee appointments, replacement procedures, distribution powers and any role assigned to a protector.

Tax Treatment: Consider Every Relevant Jurisdiction

The Belize Trusts Act provides specified local tax exemptions for duly registered international trusts that continue to satisfy the applicable requirements.

Those exemptions do not determine the tax treatment elsewhere. Depending on the countries involved, establishing or funding a trust, earning income, or making distributions may create tax and reporting obligations for the settlor, trustee or beneficiaries.

Tax advice should therefore be obtained in the relevant jurisdictions before assets are transferred. A trust should not be selected on the assumption that an offshore structure automatically reduces tax.

What Should You Assess Before Proceeding?

An initial assessment should establish:

  • Your objectives: succession, support for beneficiaries, continuity of ownership or asset protection planning.

  • The parties involved: their residence, tax residence and any relevant nationality considerations.

  • The assets: their value, location, ownership and any restrictions on transfer.

  • Your expectations of control: which decisions the trustee will make and what oversight arrangements are appropriate.

  • Existing obligations: including loans, security interests, disputes and court orders.

  • The ongoing commitment: trustee administration, recordkeeping, professional advice and applicable reporting.

Trustee selection is equally important. Relevant experience, service standards, fees and procedures for distributions should be reviewed before appointment.

How Much Does a Belize International Trust Cost?

Costs depend on the complexity of the deed, the assets, the parties’ circumstances and the trustee’s responsibilities.

A quotation should distinguish establishment costs from recurring administration and identify any additional charges for transactions, distributions, amendments or specialist advice. Comparing scope alongside price helps avoid unexpected costs later.
